Warum das BTMG schizophren ist.
Das BTMG ist vergleichbar mit einem schizophrenen Menschen. Einerseits regelt es durchaus wichtige Angelegenheiten - ehrlich, ich bin froh, dass nur ein ausgebildeter Personenkreis Medikamente herstellen, vertreiben und verschreiben darf.
Auf der anderen Seite werden tausende Menschen durch das BTMG kriminalisiert. Menschen, deren einzige Schuld es ist, eine Substanz zu konsumieren. Zwar ist der Konsum offiziell legal, aber bevor man etwas konsumieren kann, muss man es sich irgendwie beschaffen - und das ist illegal. So straft man die Konsumenten durch die Hintertür dennoch ab.
Um das klarzustellen - wenn jemand seinen Drogenkonsum durch Diebstähle finanziert, ist das keine “Beschaffungskriminalität”. Wir brauchen keinen speziellen Straftatbestand, um Diebe zu bestrafen. Ein Dieb ist ein Dieb, egal warum er stiehlt.
Aber was wir brauchen sind Gesetze, die es uns erlauben unsere Drogen legal zu erwerben. Warum? Nun, wenn es eine Tatsache gibt, die weder von Drogenbefürwortern noch von Drogengegnern bestritten ist, dann ist dies die Tatsache dass trotz aller Verbote eine Nachfrage nach Drogen existiert.
Die Nachfrage ist vorhanden - die einzige Frage ist nun, ob wir diesen Markt der organisierten Kriminalität überlassen, oder ihn staatlich regulieren und besteuern.
Why the BTMG is shizophrenic
Our german drug laws, the “Betäubungsmittelgesetz” (or BTMG) can be classified as shizophrenic. On one side, it contains really useful regulations - seriously, i’m glad that only specially educated people are allowed to produce, sell or prescribe medicine.
But on the other hand the BTMG criminalizes thousands of people. People whose only crime is to consume substances. Here in Germany, the law says that consuming it is legal - but before you can consume something, you have to acquire it one way or another. And this is illegal, no matter if you buy it or grow it. What a convenient backdoor to punish the consumers.
To get this straight - if someone finances his drugs by stealing, that is a crime. Here in Germany, they coined the term “Beschaffungskriminalität” for crimes that were convicted by drug addicts to finance their habit. But we don’t need a special treatment for people who commit crimes because they do drugs. A thief is a thief, not matter why he steals.
But what we need are laws which allow us to acquire our drugs legally. Why? Well, if there is one fact that is undisputed between friends and foes of legalization, then it’s the fact that despite all sanctions the demand for drugs still exists.
So, the demand is there. The only question left is: should we leave this market to the organized crime, or should we regulate and tax it?
